Version: 2026-10 · Effective from the date of publication
These Terms set out the conditions for the business (B2B) and public-sector (B2G) use of the Erinvia skills measurement service. Erinvia does not contract with consumers. The data processing agreement in Annex 1 forms an integral part of these Terms; Annex 2 lists the highlighted terms that must be accepted separately at registration. These Terms are a translation of the Hungarian original; in the event of any discrepancy, the Hungarian text prevails.
1. The Provider and the scope of these Terms
1.1. The Erinvia service is provided by the following business (the Provider):
| Name | Coconut PR |
| Registered office | Sarkantyú u. 67., 6771 Szeged, Hungary |
| Company registration number | 06-06-016603 |
| Tax number | 25013913-1-06 |
| Bank account number | 12100011-17628622-00000000 |
| info@coconutpr.hu | |
| Website | erinvia.com |
| Application | app.erinvia.com |
| Hosting provider | Tárhely.Eu Szolgáltató Kft. |
1.2. These Terms contain the general conditions of the contract between the Provider and the business, institution or other organisation using the service (the Client).
1.3. The service may be used solely for the Client’s business, professional or public-service activities. The Provider does not contract with consumers (Section 8:1(1)(3) of the Hungarian Civil Code); consumer protection rules therefore do not apply.
1.4. The following form an integral part of these Terms: the data processing agreement in Annex 1, the highlighted terms listed in Annex 2, and the fees in force from time to time (published on the website and on the Buy credits page of the application).
1.5. Any different provision of an individual contract or a written individual offer takes precedence over these Terms.
2. Definitions
| Term | Meaning |
|---|---|
| Erinvia, service | The Provider’s online skills measurement system (website, web application, mobile application) and the related services. |
| Client | The organisation using the service; the company account belongs to the Client. |
| Operator | A person given access rights in the system by the Client: a Manager (manages the account, handles purchases and measurements) and an Expert (a person appointed by the Client to interpret results). |
| Respondent | An employee (development measurement) or candidate (selection measurement) taking part in a measurement. |
| Campaign | The framework for the Client’s measurements; the number of measurements that can be started per campaign is shown on the website. |
| Measurement | An assessment set up for a defined set of skills, period and group of respondents. Types: development measurement (team, training needs) and selection measurement (comparing candidates). |
| Basic measurement, Full measurement | The two redemption modes of a measurement; the number of skills that can be selected in each mode is shown on the website. |
| Credit | The unit of account for the price of the service, which the Client buys in advance and redeems when measuring. |
| Free taster | A measurement without credits, available once per company (Section 6). |
| Re-measurement | A repeat of a started base measurement with the same skills and conditions. |
| Report | The summaries, overviews and exports produced from the results of a measurement, in line with access rights. |
| AI assistant | The artificial-intelligence-based consultant that helps operators set up measurements (in the application: Orin). |
3. Conclusion of the contract
3.1. The contract is concluded through company registration. The registrant provides the Client’s name, their own name, their company e-mail address and the Client’s tax number, accepts these Terms and, separately, the highlighted terms listed in Annex 2, and then sets a password via the link received in the confirmation e-mail. The contract is concluded when the account is confirmed.
3.2. The registrant declares that they are authorised to act on behalf of the Client and to conclude the contract. One company account may belong to one tax number; registration with private or disposable mailboxes is not possible.
3.3. The contract is concluded electronically and qualifies as a declaration made in writing. The Provider does not file the contract, but records the accepted version of these Terms and the time of acceptance at every acceptance (registration, credit purchase, amendment of these Terms); the current text of these Terms is available, downloadable and printable on the website. The language of the contract is Hungarian. The Provider does not subscribe to any code of conduct.
3.4. Data entry errors can be corrected at any time before the registration form is submitted; company and billing details can later be changed in the application (Account → Company).
3.5. The Provider may refuse a registration without giving reasons, in particular where data is incomplete or untrue, after a previous breach of contract, or where misuse of the free taster is suspected.
4. The service
4.1. Erinvia provides online skills measurement: respondents answer short daily question blocks spread over time, and the system produces reports, overviews and exports from the results. Measurements are set up by the Manager (skills, period, group of respondents, breakdown criteria), also with the help of the AI assistant.
4.2. Data visible to the Client:
- Development measurement: the Client sees progress by name (not started, in progress, completed) and results in aggregate. Individual results are visible only if the respondent shares them. Aggregates for small groups appear only with the number of consents required by law and by the system’s rules.
- Selection measurement: the Client sees candidates by name, with an individual report, with the candidate’s consent.
- Results related to wellbeing are shown to the Client only in aggregate.
4.3. Decisions are always made by people. The result of a measurement is for information only and may be just one element of a human decision-making process; it is not a statement of fact and may not be the sole basis of any decision relating to employment. The system does not make automated decisions.
4.4. The content of the service (skills catalogue, question bank, reports, features) may change as it is developed; the conditions of a measurement already started (package, skills) do not change until the end of that measurement.
4.5. The measurement languages available are shown on the website.
5. Credits, fees and payment
5.1. The Client pays for the service in credits. Credits are bought in advance, in credit packs; the current packs and prices are shown on the website and on the Buy credits page of the application. When purchasing, the Client accepts these Terms on the Buy credits page by ticking a checkbox. For quantities above the published packs, the Provider may make an individual offer.
5.2. Redemption: the credit requirement per person for Basic and Full measurements is shown on the website and in the application; the value in force when the measurement is started applies. Credits are deducted when the respondent gives their first answer in the measurement; a respondent who consented but did not answer a single question does not consume credits. A re-measurement is available for the participants of the base measurement within the deadline and with the discount published from time to time.
5.3. Validity: credits can be used for 24 months from purchase. Expired credits lapse. Credits have no monetary value: they cannot be exchanged for cash or transferred, and their price is not refunded, except in the case of defective performance under Section 12.2.
5.4. Payment:
- by bank card, through the payment service provider named on the website; credits are added immediately after successful payment;
- by bank transfer against a pro forma invoice; credits are added once the purchase price has been credited to the Provider’s bank account.
Card details are handled exclusively by the payment service provider.
5.5. Invoicing and tax: the Provider issues invoices electronically and sends them by e-mail; invoices can also be downloaded in the application. A Client in Hungary pays in forints, with the VAT in force as shown on the invoice (without VAT in case of tax exemption). A Client in another EU Member State pays in euros, under the reverse-charge mechanism if it has a valid EU VAT number; the Provider checks the EU VAT number before purchase. A Client outside the EU pays in euros, outside the scope of Hungarian VAT.
5.6. Any objection to an invoice must be made in writing within 10 days of receipt; after that, the invoice is deemed accepted.
5.7. In the event of late payment, the Provider may charge default interest and a fixed recovery cost under the Hungarian Civil Code (Section 6:155), and may suspend the service.
5.8. Price changes do not affect credits already purchased.
5.9. Refunds: fees paid are not refunded, except in the case of defective performance under Section 12.2. The Client is not a consumer, and therefore has no right of withdrawal or cancellation under the rules on consumer contracts (Hungarian Government Decree 45/2014 (II.26.)). This is a highlighted term under Annex 2.
6. Free taster
6.1. Once per company, without buying credits, the Client may start one measurement within the headcount and skill limits published on the website, with an aggregate team report. The Client chooses when the measurement starts; it may also be started with fewer people than the limit.
6.2. The taster is available only to a Client registered via the free route, or to whom the Provider expressly offers it. The taster cannot be re-measured.
6.3. The Provider may refuse or withdraw the taster and suspend the account if it detects circumstances indicating misuse (for example, several accounts of the same organisation, a group of respondents overlapping with another free account, untrue data). In that case the Client may use the service with a paid credit pack.
6.4. To the fullest extent permitted by law, the Provider accepts no liability whatsoever for the free taster.
7. Obligations of the Client
7.1. The Client may use the service only for lawful purposes. It may not measure for unlawful or discriminatory purposes, or for purposes that harm the legitimate interests of respondents, and may not collect data suitable for discrimination.
7.2. The controller of the measurement data is the Client (Section 8). The Client is responsible for:
- informing respondents in advance, in accordance with the law, about the purpose and legal basis of the measurement and about the processing of their data;
- having an appropriate legal basis for the processing, and complying with the rules of employment law, data protection and equal treatment;
- making the declarations requested by the system truthfully in selection measurements and when measuring sensitive skills;
- using the result of the measurement as part of human decision-making, in accordance with Section 4.3.
7.3. The Client may not attempt to link aggregated or de-identified respondent data to an individual, and may not oblige a respondent to share their individual result.
7.4. The Client is responsible for operator access: it keeps passwords and two-step verification devices secret, limits access rights to what is necessary, and reports unauthorised access without delay. The Client is responsible for all actions carried out in its account.
7.5. The Client keeps its company and billing details up to date.
7.6. The Client may not use the service to disrupt the operation of the system, to circumvent its security, for automated data collection, or for any activity prohibited in Section 9.
8. Data protection
8.1. The measurement data belongs to the Client: the Client is the controller of the respondents’ measurement data, and the Provider is its processor. The terms of processing are set out in Annex 1, which comes into effect on acceptance of these Terms.
8.2. The Provider is an independent controller for the data of operator accounts, company registration, credit purchases and invoicing, and security logs. Details are set out in the Privacy Notice (B2B and B2G) available on erinvia.com.
8.3. The Provider may create anonymous aggregates from the measurement data that cannot be traced back to any person, and may use them to build comparison norms and to develop the service; these contain no names, identifiers, companies or campaigns. By accepting these Terms, the Client consents to this.
8.4. Measurement data remains available in the system for 365 days from the close of the campaign and is then deleted automatically; on termination of the contract, Section 13.5 applies.
9. Intellectual property and confidentiality
9.1. Erinvia’s software, question bank (questions, answer options, variants), scoring and measurement methodology, norms, report and interface design, and the related documentation are the Provider’s intellectual property, and may be protected by copyright and — as regards the subject of the patent application — by patent. The contract does not give the Client ownership of any of these.
9.2. For the term of the contract, the Provider grants a non-exclusive, non-transferable, non-sublicensable right to use the service as intended. The Client may use reports and exports for its own internal purposes even after the contract ends.
9.3. It is prohibited to copy, publish or pass on to third parties the questions, answer options or methodology; to reverse engineer the software; to collect the content of the service by automated means; or to use the service to develop or benchmark a competing product.
9.4. The parties treat each other’s business secrets, the fees and the individual terms as confidential, and share them only with persons bound by confidentiality, to the extent necessary to perform the contract. Confidentiality survives the termination of the contract.
9.5. The Provider may use feedback and suggestions about the service given by the Client freely and free of charge.
9.6. The Provider may display the Client’s name and logo as a reference only with the Client’s prior consent.
10. Artificial intelligence
10.1. The AI assistant helps operators set up measurements (skills, timing, criteria); its suggestions are approved by the operator. The AI assistant has no access to respondents’ answers or individual results.
10.2. Measurements are scored according to predefined psychometric rules. The system makes no automated decisions about respondents and does not rank them in anyone’s place (Section 4.3).
10.3. The Provider does not use the data of the Client or of respondents to train artificial intelligence models, and does not pass it to others for that purpose. The provider of the AI assistant acts as a sub-processor (Annex 1).
10.4. The AI assistant’s answers are for information only and may contain errors; the Client is responsible for the correctness of the set-up and for starting the measurement.
11. Availability and changes
11.1. The Provider endeavours to keep the service running continuously, but does not commit to any numerical availability level. The service may be interrupted for maintenance, development, security measures, the outage of a third-party provider (hosting, payment, invoicing, AI provider) or force majeure.
11.2. Where possible, the Provider announces planned maintenance in advance in the application or by e-mail.
11.3. The Provider may develop and modify the features, the interface and the skills catalogue; the conditions of a measurement already started do not change (Section 4.4).
11.4. The Client can download reports and exports from the system regularly; the Client is responsible for keeping its own copies of the data.
12. Defective performance and liability
12.1. The Client reports any defect in the service in writing, with a description of the defect, within 8 days of discovering it.
12.2. In the case of defective performance, the Provider will first repair the defect. If repair is not possible, the Provider will re-credit the credits used for the affected measurement; if the Client can no longer use the credits, the Provider will refund their proportionate price. Beyond this, the Client has no other claim on grounds of defective performance.
12.3. To the fullest extent permitted by law, the Provider expressly excludes its liability for damage caused by breach of contract.
12.4. In particular, the Provider is not liable for:
- the consequences of the Client’s employment, selection or development decisions;
- results arising from untrue, incomplete or careless answers by respondents;
- indirect damage, lost profit, or business or reputational loss;
- the outage of third-party providers, or force majeure;
- data not exported by the Client within the period set out in Section 13.5;
- damage arising from the compromise of operator access at the Client.
12.5. Indemnity: the Client indemnifies the Provider against all claims, fines and costs asserted against the Provider by third parties (in particular respondents, employees, candidates or authorities) because of the Client’s unlawful use, breach of the obligations in Section 7, or failure to meet its obligations as controller.
12.6. Time limit for claims: the Client may enforce claims arising from the contract within 1 year of becoming aware of them; after that, the claim is time-barred.
13. Suspension, termination, data
13.1. Termination by the Client: the Client may terminate the contract at any time, without giving reasons, with immediate effect. In that case, unused credits and fees paid are not refunded. The Client has no consumer right of withdrawal (Section 5.9).
13.2. Ordinary termination by the Provider: the Provider may terminate the contract by e-mail with 30 days’ notice. During the notice period the Client may use its credits; credits remaining after the notice period has expired are not refunded.
13.3. Termination with immediate effect: the Provider may terminate the contract with immediate effect if the Client seriously breaches the contract, in particular if it:
- fails to settle its outstanding fees despite a reminder;
- uses the service unlawfully or in breach of Section 7;
- engages in an activity prohibited in Section 9;
- endangers the security of the system or the data of other users;
- provided untrue data at registration.
13.4. Suspension: in the cases listed in Section 13.3, and in the event of a security incident or an order of an authority, the Provider may suspend access instead of, or before, terminating the contract. The Provider notifies the Client of the suspension by e-mail. The expiry period of credits is not extended during the suspension.
13.5. Data after termination: after the contract ends, the Client’s operators may still sign in for 60 days and download reports and exports; they may not start new measurements. When the 60 days have passed, the Provider deletes the Client’s account and the measurement data. Exceptions are accounting records that must be kept by law, and the anonymous aggregates under Section 8.3. In the case of termination with immediate effect, the Provider provides the export by e-mail on request within the 60 days.
13.6. Termination of the contract does not affect Sections 9 (intellectual property and confidentiality), 12 (liability), 13.5 and 15, or payment obligations that fell due before termination.
14. Amendment of these Terms
14.1. The Provider may amend these Terms and the price list unilaterally. It notifies the Client of the amendment by e-mail at least 30 days before it takes effect, and publishes it on erinvia.com.
14.2. If the Client does not accept the amendment, it may terminate the contract under Section 13.1 by the date on which the amendment takes effect; unused credits and fees paid are not refunded in this case either. If the Client does not terminate and continues to use the service after the amendment takes effect, the amendment is deemed accepted.
14.3. The Client accepts amendments affecting the highlighted terms in Annex 2 separately, in the application, at its next sign-in.
14.4. Amendments solely in the Client’s favour, and amendments required by a change in the law or by an order of an authority, may take effect at shorter notice than 30 days, or even immediately.
14.5. Amendments to the price list do not affect the price of credits already purchased or the conditions of measurements already started.
15. Governing law, disputes, language, contact
15.1. The contract is governed by Hungarian law, in particular Act V of 2013 on the Civil Code (Ptk.) and Act CVIII of 2001 on electronic commerce services (Ekertv.). The United Nations Convention on Contracts for the International Sale of Goods (Vienna Convention) does not apply.
15.2. The parties first try to settle their disputes by negotiation. If this does not lead to a result within 30 days, the parties stipulate the exclusive jurisdiction of the Szeged District Court or the Szeged Regional Court, depending on subject-matter jurisdiction.
15.3. These Terms are available in Hungarian and English. In the event of any discrepancy, the Hungarian text prevails.
15.4. If any provision of these Terms is invalid or unenforceable, this does not affect the validity of the other provisions; the invalid provision is replaced by the lawful rule closest to the parties’ intention.
15.5. These Terms and the individual order together constitute the entire agreement of the parties. In the event of any discrepancy, the individual terms accepted in writing prevail. The Client’s general terms and conditions do not form part of the contract.
15.6. The Client may assign its rights and obligations under the contract only with the Provider’s prior written consent. E-mail counts as written communication.
15.7. Contact: info@coconutpr.hu. The Provider’s details are set out in Section 1.
15.8. Effect: these Terms (version: 2026-10) take effect on the date of their publication on the website and remain in force until withdrawn or amended.
Annex 1 — Data processing agreement (Article 28 GDPR)
This Annex comes into effect on acceptance of these Terms, between the Client as controller and the Provider as processor.
A1. Subject matter and duration. The Provider processes personal data relating to the Client’s measurements solely to provide the service: sending out, completing and scoring measurements, producing and storing reports, and delivering notifications. Processing lasts for the term of the contract and for the 60 days under Section 13.5 of these Terms.
A2. Data subjects and categories of data.
| Data subjects | Categories of data |
|---|---|
| Respondents (employees, candidates, students, clients) | name or pseudonym, e-mail address (if provided by the Client), grouping data set by the Client, answers, scores, reports, completion times, technical logs |
| The Client’s operators | name, e-mail address, role, sign-in and activity logs |
The service does not collect special categories of data (Article 9 GDPR); the Client may not upload any.
A3. Instructions. The Provider processes the data only on the Client’s documented instructions; these Terms and the Client’s settings and actions in the application count as instructions. If, in the Provider’s view, an instruction infringes the law, it informs the Client without delay.
A4. Confidentiality. The Provider gives access to the data only to persons who are bound by confidentiality and need it for their tasks.
A5. Security (Article 32 GDPR). The Provider applies at least the following measures: encrypted data transfer (HTTPS); role-based access; mandatory two-step verification for privileged access rights; passwords stored only as hashes; activity logging; regular backups; a security backup and multi-step approval before deletion; results visible only to authorised roles and, above a minimum headcount, in aggregate.
A6. Sub-processors. The Client gives a general authorisation to engage sub-processors. The current sub-processors are:
| Sub-processor | Task | Location |
|---|---|---|
| Tárhely.Eu Szolgáltató Kft. | hosting, database, e-mail delivery | Hungary (EU) |
| Anthropic | AI assistant for set-up (Section 10); receives no respondent data | United States |
| Mobile push providers (Google, Apple) | delivering notifications to the mobile application | EU / United States |
The Provider notifies the Client by e-mail at least 30 days before engaging a new sub-processor. During this period the Client may object on reasonable data protection grounds; if the parties cannot find a solution, the Client may terminate under Section 13.1. The Provider imposes obligations on the sub-processor equivalent to those in this Annex.
A7. Transfers to third countries. Transfers outside the EEA take place on the basis of an adequacy decision (in particular the EU–US Data Privacy Framework) or the standard contractual clauses (SCCs) adopted by the European Commission.
A8. Data subject rights. The Provider helps the Client respond to data subject requests through the features of the application (export, deletion, rectification) and on request. It forwards any request it receives to the Client without delay and does not respond to it independently.
A9. Personal data breaches. The Provider notifies the affected Client of a breach without undue delay, where possible within 48 hours of becoming aware of it, and provides the information available to it for the notification under Article 33 GDPR. The Provider assists with data protection impact assessments and prior consultation with the information available to it.
A10. Return and deletion. After the contract ends, the Client may export the data for 60 days; after that, the Provider deletes it unless the law requires it to be stored. Data disappears from backups through the normal backup rotation.
A11. Audits. The Provider makes available the information needed to demonstrate compliance primarily in the form of written documentation. An on-site audit may take place at most once a year, at a time agreed 30 days in advance, subject to confidentiality and at the Client’s expense, in a way that gives no access to other Clients’ data.
A12. Anonymous aggregates. The anonymous aggregates under Section 8.3 of these Terms, which cannot be traced back to any person, are not personal data; this Annex does not apply to them.
A13. Liability. The parties’ liability is governed by Article 82 GDPR and Section 12 of these Terms.
Annex 2 — Highlighted terms (Section 6:78 of the Hungarian Civil Code)
At registration — separately from accepting these Terms — the Client expressly accepts the following terms, which differ from customary contractual practice:
- No refunds: the price of purchased credits is refunded only in the case of defective performance, under Section 12.2; the Client has no consumer right of withdrawal (Section 5).
- Expiry: credits expire 24 months after purchase and cannot be exchanged for cash (Section 5).
- Nothing is refunded on termination: whatever the reason for termination of the contract, unused credits and fees paid are not refunded (Section 13).
- Exclusion of liability: to the fullest extent permitted by law, the Provider expressly excludes its liability for damage caused by breach of contract (Sections 12.3–12.4).
- Indemnity: the Client indemnifies the Provider against claims asserted by third parties because of the Client’s use (Section 12.5).
- Time limit for claims: claims arising from the contract are time-barred after 1 year (Section 12.6).
- Unilateral amendment: the Provider may amend these Terms and the price list with 30 days’ prior notice; if the Client rejects the amendment, it may terminate without a refund (Section 14).
- Free taster: the Provider may refuse or withdraw the free taster without giving reasons and is not liable for it (Section 6).
- Data deletion: 60 days after the contract ends, the Provider deletes the account and the measurement data; measurement data is in any case deleted 365 days after the close of the campaign (Sections 8.4 and 13.5).
- Exclusive jurisdiction: in the event of a dispute, the Szeged District Court or the Szeged Regional Court has jurisdiction (Section 15.2).
Acceptance in the application: “I have read and expressly accept the highlighted (non-standard) terms listed in Annex 2 of the Terms and Conditions.” (separate checkbox; the system logs the accepted version of the Terms and the time)
